Terms of Service
Short version: You pay per connected device. Your data is yours. We provide 99.8% uptime. Use the platform legally and responsibly. Either party can terminate. Argentine law applies. Questions: legal@ourconnectedsystems.com
1. Acceptance
By accessing or using the Our Connected Systems platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
Our Connected Systems provides a cloud-based IoT connectivity platform including:
- A high-performance MQTT broker (versions 3.1.1 and 5.0)
- X.509 certificate-based device identity and authentication
- Device management dashboard and REST/WebSocket API
- Real-time monitoring and telemetry routing
- Add-on services such as protocol bridges and technical consulting (quoted separately)
The Service does not include on-premise software deployments unless expressly agreed in writing.
3. Account Registration
You must provide accurate, complete, and current information when registering. You are responsible for:
- Maintaining the confidentiality of your credentials and API keys
- All activity that occurs under your account
- Notifying us immediately at legal@ourconnectedsystems.com if you suspect unauthorized access
4. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to transmit illegal, harmful, or fraudulent content
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Resell or sublicense access to the Service without written authorization
- Use the Service to send unsolicited communications or conduct denial-of-service attacks
- Reverse-engineer, decompile, or extract source code from the platform
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
5. Pricing and Billing
5.1 Per-Device Billing
The Service is billed based on the number of concurrently connected devices during the billing period:

5.2 Payment
- Invoices are issued monthly based on peak concurrent device count.
- Payment is due within 15 days of invoice date.
- Overdue accounts may be suspended after a 5-business-day grace period with notice.
- All prices are in USD and exclude applicable taxes.
5.3 Add-on Services
Protocol bridges, technical consulting, custom PKI integration, and other professional services are billed separately under individual statements of work.
6. Service Level Agreement (SLA)
- Uptime commitment: 99.8% monthly availability of the MQTT broker service.
- Exclusions: Scheduled maintenance (notified 48 hours in advance), force majeure events, or issues caused by your devices or network.
- Remedy: If we fail to meet the SLA in a calendar month, you may request a service credit equal to the pro-rated value of the downtime, up to 10% of that month's invoice.
Uptime is measured from our monitoring infrastructure and calculated as: (total minutes − downtime minutes) / total minutes × 100.
7. Data Ownership
Your data is yours. You retain full ownership of:
- All data generated by your IoT devices
- Your device configuration, certificates, and metadata
- Any content published through your MQTT topics
We act as a data processor on your behalf. We do not use your device data for any purpose other than providing the Service. See our Privacy Policy for details.
8. Intellectual Property
All rights to the Our Connected Systems platform, software, documentation, trademarks, and related materials are owned by or licensed to Our Connected Systems. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
9. Large-Scale Deployments
Deployments exceeding 10,000 concurrent connections require infrastructure provisioning. After purchase, our engineering team will work with you during a 5–7 business day onboarding period to configure and validate full operational capacity.
10. Confidentiality
Each party agrees to keep confidential any non-public information received from the other party and marked as confidential, and to use it only for the purposes of this agreement. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
11. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, uninterrupted, or free from security vulnerabilities beyond our reasonable control.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR CONNECTED SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the Service in the 3 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Our Connected Systems, its officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
14. Termination
- By you: You may cancel your account at any time through the platform dashboard. Cancellation takes effect at the end of the current billing cycle.
- By us: We may suspend or terminate your account immediately for violation of these Terms, non-payment (after the grace period), or if required by law.
- Effect of termination: Upon termination, your access ends and your data will be deleted after 30 days, during which you may request an export.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Argentina. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the ordinary courts of the City of Buenos Aires, Argentina.
16. Changes to These Terms
We may modify these Terms at any time. We will notify you by email at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
